Fani Willis Asks Court to Reinstate Charges Against Trump Associates

(DailyChive.com) – Fulton County District Attorney Fani Willis is asking a Georgia appeals court to bring back six criminal charges against former President Trump and his co-defendants. These charges, which are part of her 2020 election case, were thrown out earlier this year by a judge.

Willis filed a request with the Georgia Court of Appeals, hoping it will reverse Fulton County Judge Scott McAfee’s earlier decision to dismiss those counts. The Atlanta Journal-Constitution first reported this development on Wednesday.

Back in March, McAfee dismissed six of the charges, saying Willis hadn’t provided enough details to support them. Just last month, McAfee also dropped two additional counts. He ruled that Willis and her team had no legal authority to bring those particular charges, which dealt with allegedly false documents filed in federal court.

Despite these setbacks, McAfee allowed the racketeering charge—a serious accusation—against Trump and all the co-defendants to remain in place. In her new filing, Willis argues that McAfee made a mistake by dismissing the six counts. “The indictment gave the defendants clear notice of the alleged wrongdoing and enough information to prepare their defense,” She claims that the original indictment gave the defendants plenty of details and context to understand the accusations and mount a defense. Willis now wants the appeals court to restore the charges numbered 2, 5, 6, 28, 36, and 38.

Trump’s lead attorney, Steve Sadow, disagreed with Willis’ argument. He told Fox News Digital that McAfee’s ruling to dismiss the charges was legally sound. “The trial court correctly found that the state didn’t meet the legal requirements for those charges under Georgia law,” Sadow said.

The case has also faced additional complications. Reports surfaced that Willis had an inappropriate relationship with Nathan Wade, a prosecutor she brought in to work on the Trump case. Wade later resigned, casting more doubt on the integrity of the investigation.

In June, the Georgia Court of Appeals put the case on hold until it decides whether Willis should be disqualified from prosecuting Trump altogether. That hearing is scheduled for December 5—just a month after the 2024 presidential election.

For now, Trump has pleaded not guilty to all charges. The legal drama continues, with both sides preparing for what promises to be a high-stakes showdown.
